Appeals Court Orders GM to Face Class Action Over Defective Transmissions

General Motors must face a class action lawsuit alleging it knowingly sold vehicles with defective transmissions, following a federal appeals court ruling. The 6th U.S. Circuit Court of Appeals determined that group lawsuits could proceed for drivers of Cadillac, Chevrolet, and GMC models equipped with 8L45 or 8L90 eight-speed automatic transmissions from the 2015 to 2019 model years. Plaintiffs claim these vehicles suffer from severe issues, such as shuddering and hesitation, which GM allegedly misrepresented as normal.
The litigation affects around 800,000 vehicles across 26 states, including 514,000 in certified classes. GM argued that class certification was unjustified due to the varying experiences of class members, but Circuit Judge Karen Nelson Moore found that claims of overpayment for defective vehicles were enough to grant standing. The case will return to U.S. District Judge David Lawson in Detroit for further proceedings.
