Family Sues BART Over Death of 74-Year-Old Woman, Alleges Safety Failures

The family of Corazon Dandan, a 74-year-old woman fatally pushed into a moving train at a San Francisco BART station, has filed a lawsuit against the transit agency, accusing it of systemic safety shortcomings. The suit, filed in Superior Court, seeks damages for wrongful death, elder abuse, and maintaining dangerous public property conditions.
The incident occurred on July 1, when Trevor Belmont, a homeless man with a history of criminal activity and a previous ban from BART stations, shoved Dandan as she was heading home from work. Despite a court order prohibiting Belmont from entering BART properties, he had repeatedly violated the ban. The lawsuit alleges BART failed to enforce these restrictions and neglected to provide adequate security to safeguard passengers.
The family highlights broader safety concerns, referencing a 2023 survey where many riders expressed fear of crime on BART. They argue that insufficient security staffing and lax fare enforcement allowed dangerous individuals like Belmont to pose ongoing risks to passengers.
In addition to seeking accountability for Dandan's death, the family hopes the lawsuit will draw attention to BART's systemic safety problems and prompt meaningful reforms to prevent similar tragedies. BART has yet to comment on the lawsuit.
